全国行政書士研修会に参加しての単なる感想

今日参加してきました、行政書士全国研修会。

ひさびさに行政書士向けの中ではよい研修会だった。

入管と民事法務という1部2部構成でしたが、そういう区分は関係なく、行政書士の土台、基本は同じなわけで(逆にいうと、専門が多岐にわかれすぎて専門性が見えないともいわれますが、こういうところに行政書士の専門性と役割があり、共通項がみいだせます)、たとえば、このテーマの本日の研修に、「許認可専門」の方が参加しても、まったく違和感がなかったのではないでしょうか。

最近は私も知的資産経営に力をいれていますから、さらによくいわれる行政書士の業務の区分からはわかれた別のジャンルですが、ここも含めてベースは一緒です。

1部の中野先生の前半は、以前に行政書士試験の学校で講師をしていたときに、私もよくこのようなことをいっていました。勉強は楽しく。私のコトバでは「日常生活ににじませる」ですが、今日紹介された映画は、たしかにその「滲ませる」やり方からみると、最良の教材だったと思います。
後半の中でも特に「泣かせる理由書」は、ごもっとも、と実感しました。泣かせようとするのではなく、きちんと事実を調べて、それに迫ったものは、自然とそうなるはずです。
2部の赤地・伊藤先生の対談も、いくつもの箇所で賛同したり、考えさせられたりしました。私にとって核心的だったのは、行政書士ならではを目指す、ということあたりでしょうか。

これはつねづねおもうところで、なぜ、業際問題がおきるのかは、業際が問題だと思っている双方が、お互いに「違い」を理解していないからにすぎないとおもいます。

以前に群馬県の4支部合同研修会で、弁護士法とのかかわりについて講義させていただきましたが、そのときにも考えたたとえ話でいうと、

「行政書士はWillcomになってはいけない」

通信、そしてかつては離れた人と会話できる、という結果的にえられる（あるいは業者側からいえば、提供できる）共通項は、携帯電話とPHSは同じでした。ただ、仕組みも方法も、特色も違います。それを、同じ土俵で、しかも「安い携帯電話」路線をひけば、勝負にならないことは明らかです。同じ、遠くの人とと会話をすることができる、という結果を生み出すとしても、仕組み、特徴の違いを活用する戦略をもたないと。

まだあのころはWillcomは破産していませんでしたが、現在は携帯会社の傘下です。そして、その結果、Willcomの特徴を活かしていたユーザーは、Willcomらしさがなくなって使いづらくなってしまいました。こうなると、選択肢としてあえてWillcomを選ぶ必要はなくなります。

このたとえでいくと、行政書士が民事法務で業際問題としてあげられる筆頭はやはり弁護士ですから、弁護士の傘下に行政書士がなる、というところでしょうか。そうなると、行政書士のよさを理解して活用していた「ユーザー」にはきっと不便になるとおもいます。

2部で伊藤先生が特徴的なことを例として出していました。若い人（最近開業した行政書士）たちが「弁護士みたいなことをしたい」といっているという例です。
私は最近あまり「若い行政書士」と話をする機会がないので、えっ？　とおもいましたが‥

そんなふうに思っている若い行政書士さん、明日といわず‥いや、この時間だから明日…あ、さらに今日は土曜だから、明日は日曜か。では、月曜朝一番で結構です。どうぞ、迷惑だから廃業届けを出してください、といいたいところです。弁護士みたいなことをやりたいならば、弁護士になるべきです。
それが微妙なところで、市民の相続のお手伝いをしたい。交通事故事務のお手伝いをしたい。離婚を円滑にすすめるお手伝いをしたい。であれば、弁護士とは違う行政書士ならではのそれに早くきづいて、市民にとって、弁護士のやり方を選ぶか、行政書士のやり方を選ぶのか、という意味で、解決方法の選択肢の一つとなってください。

大阪にいくのには、新幹線も飛行機もあれば、船も車も自転車も、徒歩だってあります。必要に応じて選択できる状態にあることが、一番市民のためになる、と私はおもいますし、このたとえでいうと、飛行機と徒歩には、業際問題はないでしょう…。

知的資産経営的にいえば、今日の対談の中でも出てきた「裁判という武器を持つ弁護士とそれをもたない行政書士」というテーマ。一般的には裁判という武器がないのは「弱み」かもしれません。が、弱みを強みにかえる‥それは行政書士の他の強み、ネットワークを活かしてこそ実現できるものだし、そこに行政書士の独自性が出てきます。独自性が出てくれば、その弱みが強みにもなりえます。
（同じことは、知的資産経営支援にもいえるわけで、他の強みとの連携あってこそ、知的資産経営支援を必要とするお客様から、行政書士の知的資産経営支援が選択されるようになるわけです）。

だいたい、値段とかフットワークの違いだけで「弁護士みたい」なことをしていては、たとえば、『ストーリーとしての競争戦略』(楠木建先生)的な目線でいけば、アホです。ポジショニングをきちんととること。本来は行政書士会がそれをやるべきですが、まったく期待できないアホの集団(すいません、これはちょっとふせた方がいいですね。赤地先生も伊藤先生も、単位会や支部から講師を依頼されると言えないとおっしゃっていましたが、そうやって思い止まれるお二人とも紳士淑女です)なので、個々の、これを理解した行政書士がつくりあげていくしかないのかな、ともおもいました。

ある程度経験をつんだ方ならば、見た目や外観、働きかける課題は同じでも（ちなみに、成果物も似ているけれど、違うというのが私見）、行政書士と弁護士はまったく違う民事法務をしている、ということはすぐに気がつくと思います。
が、そういう方々がそれぞれの団体をとりしきっていないのか。わかってはいるけれど意地とか見栄とかで目をそらしているのか。はたまた利権がからんでいるのかはわかりませんが、そんな業際の争いをしていることが、一番国民のためにならないことは明らかです。
国民のためにならないこと‥は、もっとも深刻な問題で、弁護士も、行政書士も、他の士業も行動基準、倫理要項があり、そこには国民の利益が明確にかかれていることに立ち返ってほしいな、と、おもうのでした。

以上は単なる感想で、赤地先生や伊藤先生ほど紳士淑女でない分だけ、ちょっと露骨に本音を書いていますが、（プラス最近の家庭の事情によるイライラ、懇親会のお酒と、前の日記のとおり、ＪＲにイライラしたこともあり）、私なりに感じたことでした。
